Capital Gains Tax Kya Hota Hai? (LTCG & STCG Explained)
When you sell a capital asset (like Stocks, Mutual Funds, Real Estate, or Gold) for a profit, that profit is called a "Capital Gain." The Income Tax department taxes this profit under the head "Income from Capital Gains." Based on how long you held the asset before selling (Holding Period), it is classified into two types:
- Short Term Capital Gains (STCG): When you sell an asset quickly. For equity, it's holding for less than 12 months. Taxed at 20% (Budget 2024).
- Long Term Capital Gains (LTCG): When you hold an asset for a longer period. For equity, holding for more than 12 months. Taxed at 12.5% (Budget 2024), but the first ₹1.25 Lakh profit is completely tax-free.

Frequently Asked Questions (FAQs)
Most asked questions about Stock Market & Property Taxes.
Naye Budget (July 2024) ke baad Equity LTCG aur STCG kitna hai?
As per the Union Budget 2024, Short Term Capital Gains (STCG) on Equity has increased from 15% to 20%. Long Term Capital Gains (LTCG) on Equity has increased from 10% to 12.5%. However, the tax-free exemption limit for LTCG has been increased from ₹1 Lakh to ₹1.25 Lakh per financial year.
Kya property bechne par Indexation ka fayda milega?
No. The Budget 2024 removed the indexation benefit for real estate sold after July 23, 2024. The LTCG tax rate on property was reduced from 20% (with indexation) to 12.5% (without indexation). A grandfathering clause later gave an option to choose the lower tax between the two for properties bought before July 2024.
Mutual funds me loss hone par kya tax bachega?
Yes. This is called "Set-Off and Carry Forward". Short Term Capital Loss (STCL) can be set off against both STCG and LTCG. However, Long Term Capital Loss (LTCL) can only be set off against LTCG. If you can't set it off entirely this year, you can carry it forward for the next 8 financial years.
Agar meri total income exemption limit se kam hai, toh STCG dena hoga?
If your total income (including STCG/LTCG) is below the basic exemption limit (₹2.5L in Old Regime or ₹3L in New Regime), you can adjust your capital gains against this shortfall. So, if you have no other income, you won't have to pay tax on capital gains up to the basic exemption limit.
Debt Funds aur FD me kya tax difference hai 2025 me?
After April 1, 2023, the tax treatment for new investments in Debt Mutual Funds and Fixed Deposits (FDs) is exactly the same. Both are taxed as per your income tax slab rate (STCG), regardless of how long you hold them. There is no LTCG or indexation benefit available for Debt funds anymore.
